    We also comply with the Data Protection Act.

    The words and terms (used below) "we", "TSL", "our" and "the company" refer to Tensile Shades Ltd.

    Product disclaimer

    We provide drawings which are intended to depict the positions of sails based on the information you have given us. These drawings are a guide and cannot be guaranteed to represent the final sail position exactly, nor do drawings predict the final diameter of any of the sails edge curves.

    If the dimensions you give us are wrong and the sail does not fit, we will provide a new sail to fit at your cost, unless we can re-cut the sail. (in which case, we will charge you to alter it and delivery back to you.)

    Easyshade

    Easyshades are designed for light outdoor use.

    They are NOT designed for high wind conditions and are NOT designed to be permanently outdoors.

    High wind conditions are defined as, more than 25 mph.

    The company will NOT accept liability for misuse of the easyshade sails, used outside.

    Payment Terms

    If you are ordering sails in accordance with a design, we will expect you to pay for the goods before dispatch.

    You therefore have the reassurance, that we will only have your money when the goods are ready and NOT for long periods of time.

    If you are ordering sails as standalone products (such as easyshade) we expect payment on order.

    If you are a commercial organisation, like an architect, contractor, interior designer we require a deposit of 70% of the total contract order, before we commence manufacture of sails. The balance is payable on delivery and install.

    Our normal method of payment is to receive your funds via direct online transfer (BACS).

    We are able to offer a card payment facility if you wish. Please note that if you pay by Credit Card we will charge a fee for doing so.

    American express is not accepted.

    Guarantees

    TSL guarantee all of our products against faulty manufacture or installations, for one year.

    Our Suppliers

    We have a policy to pay all of our suppliers within seven days.

    Installation

    Canopies are large wind resisting objects. Wind is variable and hard to predict. Large canopies are can be subjected to high point loads and it is therefore imperative that they are installed correctly. Severe damage can occur to buildings gardens etc.

    Hyparlite products are self install generally, and rely on solid fixings. Where we supply goods to you, which you install yourself, we urge you to consult us before installing or commission a competent contractor to do the works.

    Care must be taken to ensure that the guy rope fixings are secured to a suitable substrate. Brick and paving, laid onto sand are not suitable. In addition, when fixing to walls or structures, you must ensure that these structures are sound and that they will not loosen or become detached.

    Cancellation

    In the case of Goods that you have ordered, you can cancel your order up to the date of delivery. If this is because you have changed your mind, we reserve the right to charge you for administration and courier charges.

    In the case of when you have ordered goods from us, which we are scheduled to install, you may also cancel anytime up to the date of delivery of goods to your premises. We reserve the right to charge you a cancellation fee of £300.00 + vat. All funds paid by you will be returned to you within 10 working days- minus the said fees above.

    Intellectual Rights

    TSL will resist in law any person attempting to copy its ideas or breach copyright and patents.

    Where we provide you with ideas, designs, written plans, etc, these remain our property and may not be used by others to achieve the same effect.

    We retain full copyright of all published material either by our websites or in print. All of our photographs, designs, product designs, fixings, edge detail and fabric as a combination are considered to be our intellectual property and may not be copied unless with our written permission.

    The brand known as Easyshade and The funky blind company are owned by Tensile Shades ltd.

    Delivery Dates

    We will not make promises that we think we cannot keep. When we provide you with a date either for a) delivery only or b) delivery and installation, we rely on experience, but cannot be held responsible for third party unreliability. If we cannot deliver within 14 days of advising you of a date, we will refund your money, without quibble.

    Complaints

    If you have a complaint, we would like to hear from you. We require this in writing. We will reply and offer a resolution within 5 working days and try to satisfy any reasonable complaint. If for some reason we cannot resolve your complaint, we will request arbitration from the Institute of Arbitrators and abide by their decision.

    Non-Payment

    Please note that any goods supplied by us -which we install- remain our property, until the final balance has been paid in full.

    We reserve the right to enter your premises to retrieve our goods if you do not pay what you owe.

    In three years of trading, it should be noted that the company, has NO outstanding disputes and has not had any written formal complaints. We have a policy of correcting our mistakes, without delay and resolving difficulties promptly and without litigation.
